How a Chapter 13 Repayment Plan Works

Chapter 13 is available to individuals with regular income whose secured and unsecured debts fall within limits set by federal bankruptcy law. Once you file, an automatic stay goes into effect immediately. This court order halts most creditor collection actions, including foreclosure sales and vehicle repossessions, while your case proceeds.

Your repayment plan is built around your income and your disposable income after allowed expenses. Plan length runs three to five years depending on your income level, and a bankruptcy judge must approve it at a plan confirmation hearing before it takes effect. Stopping Foreclosure & Repossession

A Chapter 13 plan can fold missed mortgage payments (mortgage arrears) into the repayment schedule, letting you catch up over the life of the plan while staying current on ongoing payments.
